Before your first drop-off: All new customers must visit the ranch and sign this waiver in person at the farm before being approved for drop-off pickups. Drop-off service is only available once you have visited and been approved.

Agreement

1. Purpose: Purchaser agrees to buy, and Happy Tails Ranch LLC agrees to sell raw cow’s milk and/or raw milk products directly from the farm or approved drop-off point.
2. Products: Raw (unpasteurized, unprocessed) cow’s milk and/or raw milk products as available.
3. Waiver: Purchaser understands raw milk is not pasteurized and may contain microorganisms that can cause illness. The purchaser has visited the farm, is making an informed decision, and assumes all risks. Purchaser waives and releases Happy Tails Ranch LLC, its owners, employees, and agents from liability related to purchase, handling, storage, or consumption.
4. Storage: Purchaser agrees to refrigerate milk ≤40°F, transport promptly, and consume within 7–14 days.
5. Deliveries: Purchaser must be pre-approved for drop-off points. The purchaser is responsible for timely pickup within the time window for each drop-off point.
6. Payment: Due at time of placing order, purchase or delivery. Accepted methods: Cash, Venmo, CashApp, Zelle, Credit/Debit Card.
7. Governing Law: This Agreement is under Kansas law.
8. Entire Agreement: This document supersedes prior agreements regarding raw milk/raw milk product sales.

Addendum: Customer-Owned Glass Jar Agreement & Monthly Raw Milk Subscription Contract

This agreement is entered into between Happy Tails Ranch LLC (“Farm”) and the above-named customer (“Customer”) for the purchase of raw milk through a monthly subscription program using customer-provided glass containers.

1. Ownership of Containers

The Customer agrees to provide and maintain their own glass jars for milk pickup or delivery.

• All jars remain the property of the Customer.
• Happy Tails Ranch LLC is not responsible for lost, broken, chipped, cracked, or damaged customer-owned containers.
• Containers deemed unsafe, damaged, or unsanitary may be refused by the Farm.

2. Container Requirements

Customer-provided containers must:

• Be food-grade glass containers with secure lids.
• Be free from cracks, chips, rust, or damage.
• Be thoroughly washed, sanitized, and dry before each return.
• Be clearly labeled with the Customer’s name.

Happy Tails Ranch LLC reserves the right to reject any container that does not meet sanitation or safety standards.

3. Cleaning and Sanitation

While Happy Tails Ranch LLC follows strict cleanliness procedures during filling, the Customer acknowledges that:

• The Farm cannot verify sanitation practices performed by the Customer.
• Milk quality and safety may be affected by improperly cleaned containers.
• The Customer assumes responsibility for maintaining their containers in sanitary condition.

4. Risk of Breakage

The Customer understands that glass containers can break during transportation, handling, storage, or customer use. Happy Tails Ranch LLC shall not be liable for:

• Broken jars
• Injuries resulting from broken glass after delivery or pickup
• Product loss caused by container failure

5. Returned Containers

The Customer agrees to return sufficient clean jars prior to the next scheduled fill date. If adequate clean containers are not provided:

• Milk may not be filled.
• Delivery or pickup may be postponed.
• The Customer may be required to purchase replacement containers from the Farm if available.
